I have been separated fro over 2 years with 2 kids under 16. My ex is filing for a divorce (he is planning to get married in just over 4 months). I know I can't contest the divorce but he does not always pay money for the kids, can I have an arrangement written in as part of the divorce or can he just get divorced without it. How long does it take normally, he has just 4 months until his wedding? The CSA is not an option as he is self employed and hides most of his salary.|||Have a look at the link below.
The article states that Scottish courts can order the payment of a capital sum or in some cases a regular payment for a limited period as part of the divorce settlement.|||if you dont sign and agree to the divorce
he has to prove separation of 5 years
yes you can have an arrangement prior to the divorce
you can have it after wards too
if he hasn't already filed
there is no way he is going to have a divorce finalized in under 4 months
he has to file
it goes before the court
then you both get papers to sign
return the papers
and then the application for a divorce is looked at|||Im pretty sure you can get maintenance written into a court order I would suggest get a good solicitor.
As for him getting married in 4 months I cant see that happening as divorce proceedings can take anything from 6 months to years. My divorce took just over 2 years with complications, My new husbands took 6 and a half months and he was in a simular situation to yours, Split for 2 years ect however they had all the children matters sorted before the divorce started so that saved time.
Good luck and I hope everything works out for you. x|||if you dont sign and agree to the divorce
